These terms of service govern your access to and use of phuocswiss.com and the services provided by Phuoc Swiss Jewelry & Diamond ("Phuoc Swiss", "we"). By using the website or placing an order, you confirm that you have read, understood and accepted the terms below.
"Website" means phuocswiss.com and its sub-pages. "Products" means the jewellery, diamonds, gemstones, watches and bespoke services provided by Phuoc Swiss. "Customer" means any individual or organisation using the website or dealing with us. "Order" means a request to purchase that we have confirmed.
You undertake to provide accurate and complete information when contacting us and placing orders, and you are responsible for the accuracy of the information you give.
Contracts of sale may be entered into only by customers aged 18 or over, or through a lawful representative.
We describe our products as accurately as we can, including gold content, weight, stone specifications and dimensions. Because of the nature of photography and colour rendering on different screens, images on the website are illustrative; actual colour and lustre may differ slightly.
Prices of gold-bearing jewellery move with the market gold price. The price shown on the website is indicative as at the time of updating; the binding price is the one confirmed by our consultant when you place the order and recorded on the invoice.
Products marked "price on request" require an individual quotation based on the actual stone specifications and workmanship.
Your order request is an offer to enter into a contract. The contract is formed when we confirm the order by telephone, email or message, stating the product, price, delivery charge, payment method and expected delivery time.
We may decline or cancel an order, with a full refund, where: the product is out of stock; product information or price was displayed incorrectly through a technical error; or there are grounds to believe the order is fraudulent.
We accept cash at our showrooms, bank transfer, and card payment through a licensed partner's payment gateway.
For products held in stock, payment is made in full before delivery, unless otherwise agreed.
For bespoke products, a deposit is paid as recorded on the order form, with the balance due on collection.
VAT invoices are issued on request, in accordance with tax law.
We deliver at our showrooms or through a carrier insured for high-value goods. The expected delivery time is given when we confirm the order.
Risk in the product passes to you when you, or a person you authorise, receive the product and sign the delivery record.
We recommend filming the unboxing. This is not a condition of any exchange or return, but it is evidence that helps us resolve a complaint quickly and conclusively.
Bespoke pieces are made to the drawing, specifications and quotation you have approved. Any change after approval may affect cost and lead time and must be re-agreed in writing or by email.
Because the piece is made for you alone, please consider the drawing carefully before approving it. The exchange and return conditions for bespoke work are set out in our Return Policy.
Your warranty entitlements and the conditions for exchange and return are set out in our Warranty Policy and Return Policy. Both form an integral part of these terms.
All content on the website, including logos, trade marks, product designs, images, text, source code and layout, is owned by Phuoc Swiss or used by us with permission.
You may not copy, distribute, modify or commercially exploit any part of it without our written consent. Sharing links to the website for personal, non-commercial purposes is welcome.
When using the website you must not:
Phuoc Swiss is responsible for the quality of its products, for the accuracy of the specifications it declares, and for meeting its warranty, exchange and return obligations.
We are not responsible for loss arising from use of a product contrary to instructions, from unauthorised repair, or from faults in your own connection or device when using the website.
Nothing in these terms excludes or limits our liability to the extent that the law does not permit it to be excluded or limited.
Neither party is liable for delay or failure in performance caused by an event of force majeure, such as natural disaster, epidemic, fire, war, strike, a decision of a competent state authority, or widespread telecommunications failure.
The affected party shall notify the other as soon as possible and make reasonable efforts to remedy the situation.
These terms are governed by the law of Vietnam.
In the event of a dispute, the parties will first seek to resolve it by good-faith negotiation and conciliation. Failing agreement, the dispute shall be referred to the competent People's Court in accordance with the law.
As a consumer you may also choose the other dispute resolution routes available under the Law on Protection of Consumer Rights, including negotiation, mediation, arbitration or the courts.
We may amend these terms to reflect legal requirements and our business operations. An amended version takes effect when published on the website. The terms applying to an order are those in force when that order was confirmed.
For questions about these terms, please use the hotline or email address shown in our footer, or visit a Phuoc Swiss showroom during opening hours.
